The co-police chief-David Eddy Thompson-imposed on Kanehsatake by James Gabriel and the Federal and Provincial Governments has been directed by the above mentioned parties to terminate the employment of Tracy Cross as his co-chief of police, as well as another police officer. A second officer resigned in protest of the unethical methods employed by Thompson et al, citing the efforts of Thompson et al in destabilizing the Kanesatake Police force. Eight police officers from the group of 65 police officers involved in the January 12th invasion have been patrolling the Village of Oka, and only the Village of Oka. Thompson and the eight police officers cite their fear of entering Kanehsatake as the reason for not going to or patrolling Kanehsatake. Thompson has stated that he is fearful and has been intimidated by community members while at the police station. The eight non-recognized police are inciting fear and intimidation within the community of Kanehsatake. The patrol officers sent By Gabriel include Larry Ross and Terry Isaac. These two police officers have been told directly by the Kanehsatake Police Commission that their involvement and presence in Kanehsatake is not welcomed, and that their presence is an incitement given the past record of violence carried out by the two within the community. Yesterday one of James Gabriel's supporting council member-Clarence Simon-released a notice (see bellow) for applicants for the new and illegal Kanesatake Public Security Commission [KPSC]. Included in this notice are the eligibility criteria for the illegal KPFC. Part of the eligibility criteria includes the stipulation for non-Kanehsatake community members to be allowed to sit on the KPSC. Kanehsatake residents find this stipulation outrageous and dangerous, once again Kanehsatake residents are being forced out of the decision making process for policing. The legality of the KPSC as well as the Tripartite Policing Agreement [TPA] is in question and has yet to be resolved by the community of Kanehsatake and hence remains an illegal agreement between the Federal and Provincial governments and James Gabriel. Concerned Kanehsatake Community Members (Text Français a suivre) New Kanesatake Mohawk Public Security Commission April 5, 2004 Under the terms of our new Tripartite Policing Agreement, the Mohawks of Kanesatake must set up a Public Security Commission to ensure the independence of the Kanesatake Mohawk Police. This Commission has a mandate which includes identifying, in consultation with the Council, strategic objectives for the Kanesatake Mohawk Police Force, establishing and supervising the implementation of policies in respect of the effective management and administration of the Kanesatake Mohawk Police Force, evaluating the performance of the KMPF, and fulfilling a public education and community service role in respect of policing services in Kanesatake. Please note that contrary to an earlier Communique, members of the Mohawk Council of Kanesatake are not eligible to be on the new Commission. The new Public Security Commission will be selected by a Selection Committee made up of the Grand Chief, the Chief responsible for policing, the Director of Education, the Director of Health and the Social Assistance Coordinator for Kanesatake. The Eligibility Criteria to become a member of the Kanesatake Mohawk Public Security Commission is attached to this Notice. Please note that these criteria now provide for a community role in appointing members of the Kanesatake Mohawk Public Security Commission, by requiring that candidates establish their credibility, in particular, through the written support of 20 members of the Kanesatake Mohawk community. This written support can be demonstrated by letter from each person who wishes to support a candidate, or by a list of names and signatures affixed to a document setting out the name of the person who wishes to become a member of the Commission and indicating support. Interested candidates must submit their names and documents in support to Chief Clarence Simon by 5:00 pm April 23, 2004. For further information, please contact Chief Clarence Simon. Eligibility Criteria for Appointment to the Kanesatake Mohawk Public Security Commission 1. To be eligible for membership on the Kanesatake Mohawk Public Security Commission an individual must: 1.1 be at least 18 years of age; 1.2 be of good moral character; 1.3 not have been found guilty, in any place, of an act or omission defined in the Criminal Code (Revised Statutes of Canada, 1985, chapter C-46) as an offence or of an offence referred to in section 183 of the Code under any of the statutes listed therein; 1.4 not occupy any elected political office, in particular, any elected political office on the Mohawk Council of Kanesatake; 1.5 not occupy a management position in the employ of the Mohawk Council of Kanesatake; 1.6 not be in the employ of the Kanesatake Mohawk Police Force or of the Kanesatake Mohawk Public Security Commission; 1.7 demonstrate interest in, and knowledge of, the Kanesatake Mohawk community; and 1.8 be able to establish his or her credibility, in particular, through the written support of 20 members of the Kanesatake Mohawk community. 2. In making its selection under Section 6 of the Agreement and pursuant to the criteria set out in section 1, above, the Selection Board will make every effort to ensure that the membership of the Kanesatake Mohawk Public Security Commission includes: 2.1 individuals with previous involvement or experience in areas of significance to its mandate, in particular, in the fields of education, health, youth, social services or policing; and 2.2 Aboriginal individuals other than members of the Mohawks of Kanesatake.
